How DEA telehealth flexibilities apply, and how we operate within them.
Ketamine is a Schedule III controlled substance. Telehealth prescribing of controlled substances is governed by the Ryan Haight Act and DEA telehealth flexibilities, which have been repeatedly extended past their original COVID-era expiration. Dr. Soffer is registered with the DEA and licensed to prescribe Schedule II-V substances in Florida and New Jersey.
We prescribe only to patients physically located in Florida or New Jersey at the time of the consultation. We do not prescribe to patients traveling temporarily, located out of state, or based outside the U.S. State licensing rules require the physician-patient relationship to be established with appropriate documentation, and we maintain that documentation for every patient.
We monitor DEA and state telehealth rule changes continuously. If federal or state regulations change in ways that affect our practice, we notify patients before any disruption to their treatment. We do not adopt practices that depend on regulatory ambiguity.
